The following terms and conditions regulate contractual relations between the visitors of the platform firstmatchmaker.com ("user") and the operator First Matchmaker( firstmatchmaker). The laws principally applied are, if not stated otherwise in these terms and conditions, the simple mandate laws of German Civil legislation.

The user may set up an account within firstmatchmaker.com and consequently has the opportunity to publish ads. One may, furthermore, post answers to existing ads and stay in contact with the desired other users by an internal mailing system. Further services complement the core system and are also part of firstmatchmaker's offer. A part of this range of services is liable for costs. The prices are indicated on the respective pages prior to the payment process.
firstmatchmaker reserve the right to refuse, delete or block a user's ad and/ or account at all times without giving reasons.
The access to most of firstmatchmaker's services are protected by password. It is the user's own responsibility to keep his password and accessibility to his account secret and safe. He is obliged to notify firstmatchmaker at once by any suspicion of abuse by thirds. firstmatchmaker cannot be held responsible for any kind of abuse of a user's account in any kind of way.
firstmatchmaker endeavour to offer a smooth functioning of the services. However, firstmatchmaker cannot guarantee uninterrupted access and use. There cannot be assertion of any claims resulting from temporary inaccessibility.
The payment of services liable for costs is executed depending on the chosen method of payment by third party firms, firstmatchmaker has no influence on this process. Refunding is generally not effectuated. Exceptions from this rule are possible by technically justified false bookings. In the case of problems with the payment process or by suspicion of wrong charging the user must notify the customer service at once.
firstmatchmaker respect current laws on data protection and, therefore, endeavour to treat confidential data most carefully and to protect these from unlawful access by third parties. User data is only collected, saved and/or analysed in so far as is necessary to provide and optimise the service. firstmatchmaker do not accept any responsibility for unlawful access to users' personal data by third persons. Assembled, and thus anonymised data, however, can be passed on to thirds.
firstmatchmaker.com can place links to external sites, whose content is examined beforehand. firstmatchmaker have no influence on the current and future lay-out and content of the linked sites. Therefore, firstmatchmaker hereby distance themselves explicitly from all content on the linked sites. The full liability for illegal, erroneous or incomplete information, in particular for damage resulting from the use or non-use of information thus offered lies with the operator of the site being referred to.
The deception of users, the use of the system for publicity without firstmatchmaker.com's approval and further incorrect usage, especially the use of the platform for commercial means, are strictly forbidden and will be persecuted consequently. This is further applied if firstmatchmaker should learn of any untruthful or indecent content or about content breaking current law. firstmatchmaker reserve the right for themselves to report above-mentioned instances to the competent authorities.
The name firstmatchmaker is a registered trademark. Adding to this hold the usual protection rights such as copy right. This may also be applied to the content of ads whose rights lie with the particular user.
firstmatchmaker merely provide services to facilitate contact between users. It is they who provide the content and are liable for its veracity and legality. firstmatchmaker endeavour to check the content as to its veracity within the bounds of the possible, but refuse to accept any responsibility for the content of the communications and its direct and indirect consequences.
firstmatchmaker reserve the right to adapt or change these terms and conditions at any time. In case of inoperativeness or invalidity of individual points, the other clauses will keep their validity.
These terms and conditions are subject to German law.
Berlin is the court of jurisdiction.
firstmatchmaker further reserve the right to validate its rights on the place of residence of the respective user or through other competent authorities.
